Annexing or Incorporating?

February 5, 2021

Today’s main action is on HB115 – Municipal Boundary Modifications.  This is the bill that portions of the Land Use Task Force worked on with Rep. Waldrip during the interim that we’ve talked about before.  The bill is up for hearing in committee this afternoon at 3:40, and it has been revised substantially, though not so much in overall effect from the original.  Take a look at the changes to the bill here.

Yesterday 1st Substitute HB107 – Subdivision Plat Amendments was passed out favorably by committee.  The League reported, Rep. Ferry testified that under this bill, before there is action taken on approving a plat, notice will be provided to an impacted canal company. The canal company will have 20 days to respond. The bill allows the canal company to provide input on access needs, maintenance needs, and provide infrastructure locations.  The bill is meant to correct problems as communities expand into traditional ag lands.

The bill now goes to the House floor for voting.

And a correction to yesterday’s update on SB164 – Utah Housing Affordability Amendments, I had stated that this bill had been endorsed by the Commission on Housing Affordability.  That was not correct.  Many of the provisions that are in the bill had been discussed and debated by the Commission, and the hope was that the Commission would get a chance to convene and review the bill before it was released, but that did not occur.  Thus the Commission had no opportunity to weigh in on the current bill.  The Commission’s next regular meeting is next week, I would expect they will discuss the bill then.
