      Hello Utah APA-

      Looking to see what ordinances you may be familiar with regarding retaining walls located within Public Utility Easements.   Any thoughts would also be appreciated.

      It is important to remember that an easement does not give “fee simple” ownership or rights to the service providers using the easement. There needs to be a balance between allowing a property owner to use their property (in the easement) and the utility being protected and accessible for the utility company. Often, a case by case analysis is appropriate as opposed to blanket restrictions. A new easement granted to a utility provider can identify specific concerns related to that specific easement.

      That would seem to depend on what the easement is for. If there are underground utilities, walls can be a problem. Above ground, the companies involved likely have clearance standards to check on. Where you have sloped properties and “it is just our tradition” to place a PUI around every lot- I’d say it is up to you but check with engineering first.
